1. Acceptance of Terms

By accessing or using the Bitpool website and platform ("Services"), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use our Services.

2. Description of Services

Bitpool provides an AI-powered building intelligence platform that connects to building systems, processes data, and delivers autonomous insights and automation. Our Services include the web platform, APIs, edge devices, and associated tools.

3. User Accounts

Some features of our Services may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use.

4. Acceptable Use

You agree not to:

  • Use our Services for any unlawful purpose or in violation of any applicable laws.
  • Attempt to gain unauthorised access to any part of our Services or systems.
  • Interfere with or disrupt the integrity or performance of our Services.
  • Reverse engineer, decompile, or disassemble any part of our platform.
  • Use our Services to transmit malicious code or harmful content.

5. Intellectual Property

All content, features, and functionality of our Services — including but not limited to text, graphics, logos, software, and design — are owned by Bitpool Pty Ltd and are protected by Australian and international intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

6. Data and Content

You retain ownership of any data you provide to our platform. By using our Services, you grant Bitpool a licence to process, store, and analyse your data solely for the purpose of providing and improving our Services. We will handle your data in accordance with our Privacy Policy.

7. Partner Terms

Partners who access our platform under a partnership agreement are subject to additional terms as outlined in their respective partner agreements. In the event of a conflict between these Terms of Service and a partner agreement, the partner agreement shall prevail.

8. Disclaimers

Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied. Bitpool does not warrant that our Services will be uninterrupted, error-free, or completely secure. Use of our platform is at your own risk.

9. Limitation of Liability

To the maximum extent permitted by law, Bitpool shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our Services. Our total liability shall not exceed the amount paid by you, if any, for accessing our Services during the twelve (12) months preceding the claim.

10. Termination

We may terminate or suspend your access to our Services at any time, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Services will immediately cease.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Australia.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on our website. Your continued use of our Services after such changes constitutes acceptance of the revised Terms.
